Illigata End User Licence Agreement

Last updated: 2026-08-02

This agreement is between you and Gabriel Jeffrey ("we", "us"), covering the Illigata application and any updates to it (the "Software"). By installing or using the Software, you accept this agreement. If you do not accept it, do not install or use the Software.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on any Mac computer that you own or control.

Your purchase covers every Mac you personally use. Install it on your desktop, your laptop and the machine at the studio. We do not count them and there is nothing to activate — the Software has no licence server and never contacts one, which is a deliberate consequence of collecting no data about you.

You may use the Software commercially. Paid client work, a studio workflow, a business — all of it is covered by the ordinary purchase. There is no separate commercial tier and no additional fee.

A licence is for one person. If you want to cover a team, buy one licence per person.

2. What you may not do

You may not: copy the Software except for a reasonable backup; rent, lease, lend, sell, redistribute or sublicense it; remove or alter any notice in it; or reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this limitation.

3. Trial and beta versions

The Software may be offered as a time-limited trial, and as beta builds for evaluation. Trials and betas may contain defects, may change without notice, and are supplied strictly "as is" — sections 7 and 8 apply to them with particular force. Do not rely on a beta build as the only tool handling irreplaceable work.

4. Your files and your content

The Software runs on your Mac and works on files you already have. You keep all rights in your own files. We claim no licence or interest in them, we do not receive them, and we cannot see them. What the Software does with your files is described in the Privacy Policy, which forms part of your agreement with us.

The Software modifies your files only when you ask it to — for example when you rate, tag, convert, rename, rotate or export. Where a conversion replaces a file, the original is moved to the Trash rather than deleted, and only after the conversion has been verified by converting back and comparing the result.

You remain responsible for backing up anything you care about. No file management tool, including this one, is a substitute for a backup.

5. Purchase, refunds and licence term

What a purchase includes. A purchase is a one-time payment for a perpetual licence to the version you buy and to every update we release within that major version. A future major version may be a paid upgrade; if it is, we will say so plainly and you may keep using the version you already bought for as long as it runs.

Refunds on direct purchases. If you buy directly from us, you may request a refund within 14 days of purchase for any reason or none. Write to hello@gabrieljeffrey.com and we will refund you. We do not ask why.

Mac App Store purchases. Refunds for App Store purchases are handled by Apple under Apple's terms. We cannot process or override them; contact Apple Support.

If the Software is discontinued. Your licence does not expire and the Software does not stop working. It has no licence server to switch off and no subscription to lapse — if we stopped developing it tomorrow, your copy would keep running for as long as macOS runs it. We are under no obligation to continue development, provide updates, or maintain compatibility with future versions of macOS.

6. Updates

The Software may check for and install updates. You can turn that off in Settings ▸ Updates. We may change, add or remove features between versions.

7. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits rights you have as a consumer that cannot be limited by agreement.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR FILES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

9. Third-party components

The Software includes open source components under their own licences, reproduced in full in the app under About ▸ Acknowledgements. Those licences govern those components.

10. Export compliance

You may not use or export the Software except as authorised by United States law and the laws of the jurisdiction in which it was obtained. You represent that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.

11. Termination

This licence ends automatically if you breach it. On termination, stop using the Software and delete it. Sections 4, 7, 8, 12 and 13 survive termination.

12. Governing law

This agreement is governed by the laws of the State of California, excluding its conflict-of-laws rules, and the state and federal courts located in California have exclusive jurisdiction over any dispute arising from it.

If you are a consumer resident in the European Union or the United Kingdom, you keep the protection of the mandatory consumer-protection law of your country of residence, and nothing in this section deprives you of the right to bring proceedings there.

13. Entire agreement

This agreement, together with the Privacy Policy, is the entire agreement between us about the Software, and it replaces any earlier understanding about it. If any provision is found unenforceable, the rest remains in force.

Appendix: Mac App Store licences

The following applies only to a copy of the Software obtained from the Mac App Store, and takes precedence over the rest of this agreement where they conflict. It exists because Apple requires specific terms in any custom licence distributed through the App Store.

  1. This agreement is between you and us alone, not with Apple. We, not Apple, are solely responsible for the Software and its content.
  2. Scope. Your licence to use the Software is limited to a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  3. Maintenance and support for the Software is our responsibility, not Apple's. Apple has no obligation to furnish any maintenance or support.
  4. Warranty. In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Software.
  5. Product claims. We, not Apple, are responsible for addressing any claims relating to the Software or your possession or use of it, including product liability claims, any claim that the Software fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  6. Intellectual property claims. In the event of a third-party claim that the Software infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce it against you.
